The right to education is one of the rights of citizens and considered a basic human and universal right. The right to education and freedom of education have special place in the Human Rights documents. In addition, domestic laws- both ordinary and constitutional- and high level documents have addressed this issue. This article intends to explain the position of the right to education in the legal system of Iran and improve the conditions governing the Iranian educational system in to answer the question: “How is the right to education evaluated in terms of factors related to it in Iran's legal system?”. To this end, after collecting the resources in a library study, deploying a descriptive-analytical method, the position of the right to education and the freedom of education in the international system and domestic law were investigated. As there is an inseparable relation between the right to education and the freedom of education, the right to education can be considered a prerequisite for the freedom of education. Based on this presumption and through examining the legal system of Iran, it is found out that at different legal levels, the legislator has correctly specified the right to education as a fundamental right. However, it seems that there are flaws and defects in this field, which of course can be solved. In fact, relying on the capacities of the Principle 15 of the Constitution of the Islamic Republic of Iran, it is possible to develop plans to explain and develop local education. Furthermore, through equipping public schools and proportionally distributing them at the country level, it is possible to take an effective step towards eliminating inequality in accessing educational facilities.
