Achieving development and ensuring that all citizens enjoy its positive outcomes is an important issue that has been endorsed by the United Nations General Assembly in an international document called the “Declaration of the Right to Development.” Since Imami jurisprudence is the basis for the formation of the Constitution of the Islamic Republic of Iran, it is essential to examine and explore the ability and flexibility of Imami jurisprudence to regulate the necessary regulations for achieving the right to development.
Based on its foundations in the Quran (the position of man from the perspective of the Holy Quran, justice in the Holy Quran, and government in the Holy Quran), the Sunnah (the narrations and history of governance in the life of the Ahl al-Bayt (AS), and the evidence of reason (the connection between reason and Sharia and the independent effectiveness of reason); the Imami jurisprudence considers the enjoyment of welfare and development by all citizens to be a general right and considers the effort to achieve development and justice to be one of the important duties of the government. Also, based on the types of existing jurisprudential rulings such as fixed and variable rulings, the ability and flexibility of laws based on founding and signature rulings, the zone of exemption, and government rulings, it is also possible to explain the position of citizenship rights in the right to development from the perspective of the Imami jurisprudence. On the other hand, in the principles of jurisprudence, the ability and flexibility necessary to regulate the laws needed to achieve the goals of the right to development have been anticipated and recognized.
The present research method in studying sources and perspectives is library and documentary, and it uses a descriptive-analytical method in examining sources.
